Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Tesseta ("we", "us") governing your use of the Tesseta apps and website (the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 18 years old to use the Service. You access the Service by signing in with a Google account, and access may be granted by request or invitation. You are responsible for maintaining the security of your account and for all activity that occurs under it. Notify us promptly of any unauthorized use.

2. The Service

Tesseta is a personal health record that gathers activity, blood markers, body composition, medications, nutrition, and training into a single view synced across your phone, watch, and the web. We may add, change, or remove features over time.

3. Not medical advice

The Service — including any charts, trends, reminders, extracted values, and AI-generated goals or programs — is provided for informational and organizational purposes only. It is not a substitute for professional medical judgment. Decisions about medications, training, nutrition, or any health matter should be made with a qualified professional. You use the Service, and any output from it, at your own discretion and risk.

4. Your content

You retain ownership of the data and files you connect, upload, or enter ("Your Content"). You grant us a limited license to store, process, and display Your Content solely to operate and provide the Service to you, including sending relevant content to the third-party processors described in our Privacy Policy. You are responsible for the accuracy of Your Content and for having the right to provide it.

5. Acceptable use

You agree not to:

• Access or attempt to access any account or data that is not your own.
• Interfere with, disrupt, or probe the security or integrity of the Service.
• Reverse engineer, scrape, or misuse the Service except as permitted by law.
• Use the Service to violate any applicable law or the rights of others.

6. Third-party services

The Service integrates with third-party services, including Google sign-in, the Google Health API, and Google's Gemini API. Your use of those services is also subject to their respective terms and policies. We are not responsible for third-party services, and their availability may affect features that depend on them.

7. Intellectual property

The Service, including its software, design, and branding, is owned by us and protected by applicable law. These Terms do not grant you any right to our trademarks or other intellectual property except the limited right to use the Service as intended.

8. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any data or output will be accurate or complete.

9. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Termination

You may stop using the Service and delete your data or account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or its users. On termination, the rights granted to you under these Terms end.

11. Changes to these Terms

We may update these Terms as the Service evolves. When we make material changes, we will update the date above and, where appropriate, notify you in the app. Continued use after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which Tesseta operates, without regard to conflict-of-laws principles.
